The aim of this paper is to analyze the relevance of John Stuart Mill freedom of
speech argument in the post truth era. The realities, in post truth era, are not
conforming between perception and reality itself, but, conversely, the realities are
adjusted by thought that made by individuals. Consequently, fake news, spinned
facts, and hate speech are rises in post-truth era. In fact, free speech is obscured by
the drawbacks of post truth era, therefore, particularly in Indonesia, either state or
society are tend to limits the right of free speech to avoid the harm of free speech.
This paper attempts to delineate the limits of freedom of speech as regards
individual freedom when state interference is justified. Our intepretation provides
that scope of individual actions in Mill’s principles of liberty are expanded and not
all individual action are categorized as other-regarding action. This further
clarifies the limits of freedom of speech and consent as a consideration to
intervene in one’s freedom. The method of study is factual-historical which
concerned on actual condition and particular arguments proposed by the
philosopher. This research were constructed by four-step process: collecting the
data set for inventory, analyzing the data to identify the problem, and arrangement
of the analyzed data as the result. The data analysis was proposed using three
methods: intepretation, description, and heuristic. Our conclusion is through the
expanded scope of individual actions in Mill’s principles of liberty, his arguments
can endure to contemporary problems of freedom of speech. |
