Abstrak/Abstract The existence of bias and discrimination in the employment sector, especially hiring, is nothing new. The presence and the use of artificial intelligence (AI), however, may either address or worsen this issue. Unfortunately, the scarcity of AI regulation left this issue unaddressed. Therefore, this study aims to analyze the current laws and policies on the use of AI in hiring and make guidelines for policymakers in governing the use of AI in hiring. This study found that the only existing law specifically on the use of AI in hiring is the New York City Local Law 144 of 2021 regarding Automated Employment Decision Tools. There are, however, a plethora of bills and policies on AI as well as AI in employment. Subsequently, this study suggests that policymakers governing AI in employment consider the definition of AI tools, the scope of AI usage, the permissible human involvement in the employment process, the scope of employment, and the compliance measures.
